FINAL DISCUSSION OF THE UPDATED LAW ON CULTURE AND FIRST DISCUSSION OF THE DRAFT LAW ON SUPPORT OF CINEMATOGRAPHY

At today's meeting of the Parliament's Standing Committee on Education, Culture, Science and Sports, the final discussion of the revised Law on Culture and the first discussion of the draft Law on Promotion of Cinematography were held. At the beginning of the meeting, G.Munkhtsetseg, Member of the State Great Hural and Head of the Working Group, made a presentation on the revised draft of the Law on Culture and the preparation of the submitted draft laws for final discussion. He said that the first discussion of the revised draft of the Law on Culture submitted by the Government of Mongolia and the draft laws submitted together with it was discussed and resolved by the plenary session on June 18, 2021 and submitted to the Standing Committee for final discussion.
During the first discussion of the plenary session, Article 20.4 or Article 52.4 of the Draft Law on Amendments to the Law on Protection of Cultural Heritage, submitted together with the revised draft of the Law on Culture, was amended as instructed by the Speaker of the State Great Hural. prepared a proposal for directing. Members of the State Great Hural asked questions and received clarifications regarding the introduction of the draft law. For example, when Munkhbat was first discussing the Law on Culture, he suggested that the protection of cultural heritage be included in the law. Therefore, it was clarified how the law regulates the protection of cultural heritage, in particular, the prevention of illegal exploration and excavation of historical and cultural immovable monuments, and the prevention of theft of cultural heritage.
In the comments of the working group, the revised version includes the issue in its entirety. In particular, the law provides for amendments to the budget, criminal and other relevant laws, as well as an increase in the number of staff.

In connection with the presentation made by the Chair of the Working Group, G.Damdinnyam, Chairman of the Standing Committee, instructed the Speaker of the State Great Hural to finalize the draft Law on Amendments to the Law on Protection of Cultural Heritage. developed a principled dissenting opinion. Therefore, a vote will be held on the wording of the dissenting opinion. Pursuant to Article 42.2.1 of the Law on Session Procedures of the State Great Hural, Article 4, paragraph 20, or Article 52, paragraph 52.4 of the draft law“Movable historical and cultural monuments will be allowed to cross the state border for no more than two years. Due to sudden or force majeure circumstances, this period may be extended once for up to one year based on the proposal of the professional council of historical and cultural monuments under the state central administrative body in charge of cultural affairs. ” The principled dissenting opinion was supported by 72.7 percent of the members present at the meeting.

The first discussion was held on the draft law on the promotion of cinema and the accompanying draft laws. G.Amartuvshin, Member of the State Great Hural, made a presentation on the preparations for the first discussion.
He said that the issue of whether to discuss the draft law on Promotion of Cinematography submitted by the Government of Mongolia was discussed at the plenary session of the State Great Hural on October 8, 2020 and referred to the Standing Committee for initial discussion. By the resolution of the Standing Committee, a working group was established to prepare the draft law on Promotion of Cinematography and the submitted draft laws for discussion at the Standing Committee meeting and general meeting. The members of the State Great Hural were G.Amartuvshin, P.Anujin, B.Bayarsaikhan and B.Jargalmaa. , J.Munkhbat and N.Uchral worked. - Introduced e-services for government services and activities in the film industry, and expanded regulations on the creation and use of databases.

Before the discussion, G. Damdinnyam, Chairman of the Standing Committee, introduced that the wording of the proposal prepared by the Working Group will be discussed on a case-by-case basis.
